These terms apply to the Ekam app and getekam.in, made by Beyondsy Solutions LLP ("we", "us"). By using Ekam you agree to them.
The agreement
These terms and our Privacy policy are the whole agreement between you and us about Ekam. If you use Ekam for a business, you agree for that business and confirm you may do so.
Your account
You sign in with your own Google account and must be 18 or over. Keep your phone locked and your PIN to yourself. You are responsible for what is done with your account. An owner is responsible for whom they invite and which roles they give.
Your business's data
The records a business keeps in Ekam belong to that business. We use them only to run Ekam for it, as our Privacy policy explains. The business is responsible for what it enters and for having a lawful reason to keep its customers' and suppliers' details.
An owner can ask us for a copy of the business's records at any time.
Bills and tax
Ekam works out totals, tax and stock from what you enter, and shows how each number was worked out. It is not tax or legal advice. You are responsible for the bills you issue, your tax returns and your GST compliance; check with your accountant when you are unsure.
Bill numbers are given by our server so they stay in one series. A bill cannot be deleted; it can be cancelled with a reason.
Payments between you and your customers
Ekam never holds or moves money. A UPI payment goes straight from the customer to the business's UPI ID. "I've paid" and payment photos are messages between the customer and the business; the business decides whether a payment was received.
Early access and price
Ekam is free during early access. Before paid plans start, owners get at least 30 days' notice, and can ask for a copy of their records or stop before paying anything. Customers, dealers and drivers do not pay.
During early access, features may change, and some may be added or removed.
Fair use
- Do not use Ekam for anything illegal, including fake bills or hiding income from tax.
- Do not send links or reminders to people who have asked you to stop.
- Do not try to see another business's data, break the app's security, or overload our servers.
- Do not copy or resell Ekam.
We may suspend an account that breaks these rules, after telling the owner unless the law or safety requires otherwise.
Availability
We work to keep Ekam running and your data backed up, but we cannot promise it will never be down or never lose a change. Much of the app keeps working without a network and catches up later.
Stopping
You can stop using Ekam at any time and ask us to delete your account. We may end the service with at least 30 days' notice; you can ask for a copy of your records before it ends. Records that the law requires a business to keep are handled as the Privacy policy explains.
Our liability
Ekam is provided as it is. To the extent the law allows, we are not liable for indirect losses, such as lost profit or lost business, and our total liability to you is limited to the fees you paid us in the 12 months before the claim. During free early access, that is nil. Nothing here limits liability that cannot be limited by law.
Law and disputes
These terms are governed by the laws of India, including the Information Technology Act, 2000. The courts at Ahmedabad, Gujarat have exclusive jurisdiction. Before going to court, both sides agree to try to settle the matter in good faith by writing to each other first.
Changes to these terms
When these terms change, we update the date at the top and list the change at the bottom of this page. If a change matters for you, we tell you by email or in the app before it applies. Using Ekam after that means you accept the change.
